1. Acceptance of Terms

By accessing and using Appship ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service.

2. Description of Service

Appship provides an AI-powered platform for App Store Optimization (ASO) that includes:

• AI-generated metadata including titles, subtitles, descriptions, and keywords for iOS, macOS, tvOS, and visionOS applications
• Direct integration with Apple App Store Connect for metadata submission
• Model Context Protocol (MCP) integration for use with Claude and other AI assistants
• Multi-locale support for international app distribution
• API access for programmatic metadata generation and submission

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your API key and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Credit System and Payments

Appship operates on a credit-based system:

• New accounts receive 5 free credits upon registration
• Each AI metadata generation operation consumes 1 credit
• Each metadata submission to App Store Connect consumes 1 credit
• Credits are non-refundable and non-transferable
• Subscription plans (Starter: 50 credits, Pro: 500 credits) are billed monthly through our payment processor
• We reserve the right to modify pricing with 30 days notice to existing subscribers

5. Apple App Store Connect Integration

By using our App Store Connect integration, you acknowledge and agree that:

• You must provide valid Apple App Store Connect API credentials (Key ID, Issuer ID, and Private Key)
• You are responsible for ensuring your credentials have appropriate permissions
• We store your Apple credentials securely but you assume responsibility for their use
• Metadata submissions are made on your behalf using your credentials
• We are not responsible for any rejection or issues with Apple regarding submitted metadata
• You must comply with Apple's App Store Review Guidelines and Developer Program License Agreement

6. AI-Generated Content

Regarding AI-generated metadata and content:

• AI-generated content is provided as suggestions and should be reviewed before submission
• We do not guarantee that generated content will be accepted by Apple
• You retain all rights to your original app information and descriptions
• We do not claim ownership of the generated metadata once delivered to you
• Generated content may be similar to content generated for other users

7. API Usage and Rate Limits

When using our API or MCP integration:

• API keys must be kept confidential and not shared publicly
• We may impose rate limits to ensure fair usage across all users
• Automated abuse or excessive requests may result in temporary or permanent suspension
• API access may be revoked for violations of these terms

8. Prohibited Uses

You agree not to use the Service to:

• Generate misleading, fraudulent, or deceptive app metadata
• Violate any applicable laws, regulations, or third-party rights
• Attempt to reverse engineer, decompile, or hack the Service
• Use the Service to compete directly with Appship
• Share your account or API credentials with unauthorized parties
• Submit metadata for apps that violate Apple's guidelines

9. Service Availability

While we strive to maintain high availability:

• The Service is provided "as is" without guaranteed uptime
• We may perform maintenance that temporarily affects availability
• Third-party service outages (Apple, AI providers) may affect functionality
• We are not liable for any losses due to service interruptions

10. Limitation of Liability

To the maximum extent permitted by law, Appship shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• App Store rejection or removal
• Business interruption
• Costs of substitute services

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the Service
• Is fraudulent or illegal

Upon termination, your right to use the Service will immediately cease. Unused credits will not be refunded upon termination for cause.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.
